
U.S. Supreme Court Rules President Cannot Impose Tariffs Under IEEPA

NEWARK, N.J.—In a highly anticipated decision, the Supreme Court of the United States (SCOTUS) issued an opinion today in the case of Learning Resources, Inc. v. Trump, holding that the President does not have the power to impose tariffs under the International Emergency Economic Powers Act (IEEPA). The 170-page opinion ruling reveals a vote of 6-3, with Justices Thomas, Alito and Kavanaugh dissenting, striking down the widespread tariffs on imports that were initiated in 2025, which have totaled an estimated $200 billion in collected duties. The ruling does not affect sector-specific tariffs imposed under Section 232 of the Trade Expansion Act, such as those on steel, aluminum and autos.
